Trademark Legal Fees

For a review of legal issues for one hour at $350 plus HST to highlight all major issues.  

Assistance with preparation of trademark application – $900 plus HST plus government fees.  Please note that this fee does not include a pre-screening or comprehensive search or registration opinion (this would entail an additional fee).  Therefore, there is a risk that if the trademark offices finds the same or confusingly similar mark, then we may not be able to proceed.  The fee only include drafting and filing a trademark application on your behalf.  All correspondence will be to your office so please ensure that you forward us all correspondence promptly if you wish us to continue to work on this file, otherwise, there is a risk that you could miss a deadline risking your trademark application.  We will send you a digital copy of your trademark application.  

Please note that you are responsible for all government fees and disbursements in addition to the legal fees noted above. • Govt fee to file at trademark application is $333 plus $100 for each additional class. We cannot say how many classes you will require until we understand your trade name and business better. 
• Prosecution stage: no charge if Examiner does not issue any Office Action
• Reporting Office Actions, advice, drafting and filing a response: approx $350 (+HST) for simple Office Actions that take no more than hour (and could be more depending on time involved)
• Approval for Publication and Allowance: approx $150 (+HST)
• Issuance and Mailing of Certificate of Registration: approx $250 (+HST) plus government issuance fee
